Terms of Use

Summary

  • RustCenter is a tool for managing your Rust servers. You alone are responsible for your servers, files, plugins and the commands you send.
  • Keep your own backups. To the fullest extent permitted by law, we are not liable for data loss, downtime, wipes, bans or damages caused by using the Service.
  • The Service is provided as is, with no guarantee that it will be uninterrupted or error-free.
  • Paid plans renew automatically every month until you cancel. Cancellation takes effect at the end of the paid period, with no prorated refund.
  • When you first subscribe to a paid plan, you may withdraw within 7 days for a full refund.
  • We are not affiliated with Facepunch, CodeFling, uMod, Oxide or Carbon.

1. Who we are and acceptance of these Terms

RustCenter — the rustcenter.org website, the RustCenter desktop app, the Server Monitor plugin and related services (the "Service") — is an independent service. In these Terms, "RustCenter", "we" and "us" refer to whoever operates the Service. Contact: eremitasfaq@gmail.com.

These Terms of Use are a contract between you and RustCenter. By creating an account, installing the app or the plugin, subscribing to a plan or using the Service in any way, you confirm that you have read, understood and accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a company, community or server team, you confirm that you are authorized to accept these Terms on its behalf, and it is bound by them as well.

2. Your account

  • You must be at least 18 years old. Minors may only use the Service with the permission and supervision of a parent or guardian, who is responsible for the minor's actions and payments.
  • Your account information must be accurate and kept up to date.
  • You must keep your login, devices and tokens secure, and you are responsible for everything done with your account, your app and your tokens, including by anyone you give access to.
  • Accounts are personal: do not share, sell or transfer access.

3. What the Service does

The Service provides tools to edit plugin configurations, manage Rust servers (installation, settings, console, players, wipes, backups, automation and Discord integration), monitor servers with Server Monitor and browse third-party plugin catalogs.

The Service is a tool: it carries out the actions you command. We do not provide administration, hosting, moderation or consulting services for your server, and we have no control over it.

We may add, change, limit or remove features, including those of the free plan, at any time. Features labeled "preview", "beta", "experimental" or "coming soon" may be incomplete, contain errors and change or be removed without notice. The app may download and install updates automatically, and the latest version may be required to keep using the Service.

4. Your responsibility for your servers

YOU ALONE ARE RESPONSIBLE FOR THE SERVERS YOU CONNECT TO THE SERVICE; FOR THE FILES, CONFIGURATIONS, MAPS, PLUGINS AND PLAYER DATA ON THOSE SERVERS; AND FOR ALL ACTIONS AND COMMANDS CARRIED OUT THROUGH THE SERVICE WITH YOUR ACCOUNT OR YOUR TOKENS.

  • Make and keep your own backups before editing configurations, installing or updating plugins, wiping, running automations or sending commands. The Service's backup features are a convenience and do not replace a backup of your own, stored outside the Service.
  • Server Monitor tokens, RCON, FTP or panel passwords and API keys give access to your server. Keep them secret, choose the appropriate access level and replace them immediately if you suspect a leak.
  • Commands sent through the remote console are executed by the server exactly as sent. Commands such as wipes, file deletion, ownerid and quit may have irreversible effects. Check before sending.
  • Scheduled wipes, restarts and automations run at the times and under the rules you configure.
  • You are responsible for complying with Facepunch's server rules, the terms of your host and of plugin stores, and the laws that apply to your server, including data protection laws regarding your players.

5. Third-party plugins, stores and trademarks

  • RustCenter is not affiliated with, sponsored or endorsed by Facepunch Studios (the developer of Rust), CodeFling, uMod, Oxide, Carbon, Discord or plugin authors. Trademarks belong to their owners and are mentioned for identification only.
  • Plugin catalogs, descriptions, images, versions, prices and ratings come from third-party sources and are shown as is: they may be incomplete, outdated or wrong. We do not sell, license or support third-party plugins.
  • Plugin downloads, purchases and licenses are between you and the store or author. You must hold the required licenses and follow their terms. We are not responsible for third-party plugins, including defects, malicious code, incompatibilities, removal from the store or changes in price or license.
  • By linking your CodeFling account, you authorize us to use the token you provide to access, on your behalf, the data and files needed for the features you use. You can unlink the account at any time.
  • Updates to Rust, Oxide, Carbon or plugins may break configurations and features of the Service without notice. We do not guarantee compatibility with any version.

6. Plans, payments and renewal

  • There is a free plan and paid plans. The features and prices of each plan are shown on the pricing page and may change under these Terms.
  • Payments are processed by Stripe. We do not receive or store your full card details. Charges appear on your statement as "RUSTCENTER".
  • You can cancel at any time from your dashboard, under Subscription. Canceling stops future charges, and your plan stays active until the end of the period already paid.
  • When you switch plans, the difference is prorated, with the credit or charge calculated by Stripe.
  • Price changes take effect from the next renewal and will be announced in advance on the website or by e-mail; you can cancel before the change takes effect.
  • Prices are in US dollars. Taxes, foreign exchange fees and other charges from your bank or card issuer are your responsibility.
  • If a payment fails, paid features may be suspended until it is settled; if further payment attempts fail, the subscription is canceled.
  • Disputing a legitimate charge with your bank (chargeback) may lead to account suspension. If you have any problem with a charge, contact us first.

SUBSCRIPTIONS ARE BILLED IN ADVANCE AND RENEW AUTOMATICALLY EACH PERIOD (MONTHLY) AT THE THEN-CURRENT PRICE UNTIL YOU CANCEL.

EXCEPT AS PROVIDED IN SECTION 7 OR OTHERWISE REQUIRED BY LAW, AMOUNTS ALREADY PAID ARE NOT REFUNDABLE, INCLUDING FOR PARTIAL OR UNUSED PERIODS.

7. Right of withdrawal

  • When you subscribe to a paid plan for the first time, you may withdraw within 7 (seven) calendar days of the purchase and receive a full refund.
  • To withdraw, write to eremitasfaq@gmail.com from your account e-mail, or include that e-mail in your message. The refund goes back to the original payment method; how long it takes to appear depends on your card issuer.
  • Automatic renewals are not new purchases and do not restart this period, unless the law requires otherwise.
  • If the law of your country of residence grants a broader right of withdrawal, it will be honored.

8. Prohibited use

You may not use the Service to:

  • break the law or infringe the rights of others;
  • access servers, accounts or data that are not yours, or without authorization;
  • distribute malicious code, or attack, overload or harm the Service, other users or third parties;
  • circumvent plan limits, payments, licenses or protections of paid plugins;
  • copy, modify, decompile, reverse engineer, resell or redistribute the app, the plugin or the website, except where the law expressly allows it;
  • collect data or access the Service by automated means we do not provide, or test for vulnerabilities without written authorization;
  • post reviews or comments that are illegal, offensive, misleading or infringe the rights of others;
  • create or distribute cheats, exploits or tools that break Facepunch's rules.

We may investigate violations and take appropriate action, such as removing content, limiting features, suspending or terminating accounts and reporting to the authorities.

9. Your content

  • The configurations, notes, reviews and other content you submit remain yours.
  • You grant us a non-exclusive, royalty-free, worldwide license, for as long as necessary, to store, process, copy and display that content solely to operate, protect and improve the Service. Public reviews and comments may be shown to other users.
  • You confirm that you hold the necessary rights to what you submit and that it does not break the law or infringe the rights of others.
  • We have no obligation to monitor content, but we may remove anything that violates these Terms.
  • We may freely use suggestions and feedback about the Service, with no obligation to pay or credit you.

10. RustCenter's intellectual property

The Service, including its software, website, brand, design and text, belongs to RustCenter or its licensors. We grant you a personal, limited, revocable, non-exclusive and non-transferable license to use the app and the plugin under these Terms. No rights are sold or transferred, and all rights not expressly granted are reserved. Open-source components are governed by their own licenses.

11. Availability and changes to the Service

  • The Service may be unavailable due to maintenance, failures, attacks, connection problems or problems with providers such as Stripe, Clerk, hosting, CodeFling, uMod, Discord and GitHub.
  • We may change, suspend or discontinue the Service, in whole or in part. If we discontinue a paid plan, we will give reasonable notice and refund the prorated amount for the paid, unused period.

12. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF UNINTERRUPTED OR ERROR-FREE OPERATION, SECURITY, ACCURACY, COMPATIBILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR RESULTS.

WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, NOR ANY RESULTS IN SERVER PERFORMANCE, PLAYER COUNT OR REVENUE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RUSTCENTER AND ITS OPERATOR ARE NOT LIABLE FOR:

  1. loss, corruption or leak of data, files, configurations, maps, inventories or player progress;
  2. server downtime, slowdowns, crashes, wipes, bans or suspensions;
  3. lost profits and loss of revenue (including donations, VIP sales and shops), players, reputation or opportunities;
  4. acts of third parties, including plugins, stores, hosts, Facepunch, internet providers, attackers and anyone with access to your account or tokens;
  5. commands, configurations and actions carried out by you or by people with your access;
  6. indirect, incidental, special, punitive or consequential damages;
  7. events beyond our reasonable control (force majeure).

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RUSTCENTER'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO RUSTCENTER IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR, IF YOU PAID NOTHING, TO US$ 10.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for willful misconduct or consumer rights that cannot be waived. In those cases, the exclusion or limitation applies to the fullest extent the law allows.

14. Indemnification

You agree to defend, indemnify and hold harmless RustCenter and its operator from any third-party claims, losses, damages, fines, costs and attorneys' fees (including from players, plugin authors, stores, hosts, Facepunch and authorities) arising from your use of the Service; your servers and content; commands and actions carried out with your account or tokens; or your violation of these Terms, the law or the rights of others.

15. Suspension, termination and account deletion

  • You can delete your account at any time from the profile menu in the top-right corner of the dashboard (Manage account → Delete account). Deleting the account cancels active subscriptions, with no refund for the current period (except under section 7), and deletes your data as described in the Privacy Policy. Save anything you want to keep beforehand.
  • We may suspend or terminate accounts, with or without notice, for violation of these Terms, fraud, unjustified payment disputes, risk to the security of the Service or of others, or legal requirement. If we terminate a paid account without any violation on your part, we will refund the prorated amount for the paid, unused period.
  • Provisions that by their nature should survive termination (such as liability, indemnification, intellectual property and governing law) remain in effect.

16. Changes to these Terms

We may change these Terms. The date at the top shows the version in effect. Material changes will be announced on the website or by e-mail before they take effect; for subscribers, changes that affect them apply from the renewal following the notice. If you keep using the Service after that, you accept the new Terms; if you do not agree, cancel and stop using the Service.

17. Communications

You agree to receive electronic communications (e-mails and notices in the dashboard or the app) about your account, billing and changes to the Service. They count as written communications.

18. Governing law and jurisdiction

  • These Terms are governed by the laws of the place where the operator of RustCenter is established.
  • Disputes will be settled by the courts of that same place, without prejudice to a consumer's right to sue in the courts of their own domicile.
  • Before taking any other step, contact us at eremitasfaq@gmail.com: most problems are solved that way.
  • Nothing in these Terms affects the rights that the consumer protection laws of your country of residence grant you on a mandatory basis.

19. General

  • These Terms, the Privacy Policy and the conditions shown at purchase are the entire agreement between you and RustCenter about the Service.
  • If any provision is held invalid, it will be enforced to the fullest extent permitted, and the remaining provisions stay in effect.
  • Not enforcing a provision does not waive it or change these Terms.
  • We may transfer this agreement to whoever comes to operate the Service (for example, in a sale or reorganization), with your rights preserved. You may not transfer it without our consent.
  • These Terms exist in Portuguese and English. In case of any conflict, the Portuguese version prevails.
